This New Jersey homeowner was picking up the pieces after a divorce and could no longer afford his home. Worse, he missed out on a previous loan modification offer from Bank of America due to confusion about the documents he received. By the time he retained us in June 2013, he was already 39 months behind on his monthly mortgage payment of $2,701.43, and was in grave danger of foreclosure. Who's to say why Bank of America hadn't filed the foreclosure lawsuit yet, but after 3 years of missing mortgage payments, it is inevitable.

Immediately after the homeowner signed his retainer agreement, we began working with him to gather documents that are necessary to create a new loan modification package. This diligent homeowner was so organized that we were able to submit his loan modification package to Bank of America by the start of the following month, July 2013. After 3 months of staying on top of Bank of America's notoriously flaky loan modification department, we obtained a permanent loan modification offer from Bank of America. His payment would be lowered by over $450 monthly to $2,244.48 and his interest rate would be dropped from 5.50% to 4.75%. Best of all, the loan modification took about 3 months to complete, even with Bank of America's terrible record of helping troubled homeowners, and the threat of foreclosure on his home had been completely avoided.

A retiree retained our law firm in mid-2012, he was over 2 years past due on his $900.00 mortgage payment to Selene Finance, and had already undergone several lifetimes' worth of trouble with various mortgage lenders. Our lawyers were able to save his home and he is enjoying his retirement in peace.

This homeowner had experienced a laundry list of problems with his subprime mortgage; his mortgage had been transferred between several different banks and servicers since 2006. One of the mortgage companies attempted to foreclose in 2009, but it was delayed because they didn't have the original mortgage paperwork. The homeowner had been served foreclosure just before he retained us.

Contrary to popular opinion, a lot of the people who lost their homes during the recent foreclosure crisis were under the burden of extenuating circumstances other than losing their job. That was the case with this homeowner. He was disabled and could no longer work full-time. He did his best to scrap by on the income from his disability checks and part-time job, but could not manage to pay his $1,100 mortgage note any longer. By the time this homeowner retained our foreclosure defense law firm, he was already over 3 years behind on paying his Wells Fargo mortgage. He had been working with another law firm to attempt to cancel a sale date that was placed on his home, but now he was looking for a law firm who could actually change his situation, not just delay the foreclosure process.

One recurring trend today is that many people who received loan modifications in the early stages of the Great Recession are attempting to get new loan modifications now. Oftentimes, these people received loan modifications before they experienced their worst hardship, and had no safety net when their hardship hit.

This happened to a homeowner who was faced with a dire situation. He was one of the first people to receive a loan modification from the HAMP program. Shortly after receiving his modification, harder times hit. The homeowner lost his job, and the family was only depending on his wife's salary for support. By the time the homeowner connected with us, he was several months past due on his $1,730 FHA mortgage payment, and had just been served foreclosure.

Many of the worst stories that have come from the mortgage crisis involve the casual ineptitude of large banks when it comes to loan modification. Thousands and thousands of foreclosures have resulted from this indiligence, and hundreds of thousands of people have had their lives negatively impacted as a result.

One Such Story

A New York woman approached us about her similar mortgage issues; she had been attempting to get a loan modification from Bank of America, but couldn't get any headway after trying for nearly two years. This homeowner was a single mother who had emerged from bankruptcy just a few years earlier; the last thing she needed was the dark cloud of foreclosure hanging over her head. However, her home could've been foreclosed on at any time; she was over 5 years and $162,000 behind on paying her $2,680 mortgage payment.

The recession hit all of America hard, but many self-employed people felt the worst part of the recession. As soon as business dried up, not only was it hard to recover lost business, but it was also hard to re-enter the traditional workforce, since many self-employed people had not worked a corporate job for years.

That is exactly what happened to one homeowner who needed our help. He had been self-employed for quite some time, and was able to make it through the worst of the recession. However, business slowed and the homeowner ended up needing to seek out work to help support his growing family. He had just managed to secure a job when he came to us for help in late December 2012, but was already over 9 months behind on his Chase mortgage, and had been served foreclosure just a few weeks before.

Many of our clients come to us after struggling with paying their mortgage for several years. That was the case with this couple.  Unlike most of our other clients, though, they were nearly 5 years behind on paying their $2,600 monthly mortgage payment. During this half-decade, they had somehow avoided foreclosure, but they knew it wouldn't be too long until their lender, Bank of America, served them foreclosure papers. This couple had already been offered a loan modification once, but could not complete the terms of the offer.

That's when they retained (hired) us in late 2012. We understood the couples' commitment to saving their home, and began to work with them to get a loan modification. In early December 2012, Bank of America denied our initial request for a loan modification, saying that they didn't believe that the couple suffered through enough hardship. By the time January arrived, we were already working to resubmit the couples' loan modification package with more updated information. While we were in the information-gathering process; the husband lost his job; we had to update the couples' information package, and then had to resubmit all their information several times thereafter.

A married couple approached us for help with their Wells Fargo mortgage. They hadn't paid their mortgage for nearly a year, had been served foreclosure and were worried about the very real threat of potentially losing their home.

As soon as this couple retained (hired) us, we began working on their case and attacking every part of their foreclosure problem. On one hand, our lawyers began working to stop the foreclosure on their home. On the other hand, our team also began working with Wells Fargo to get a mortgage modification. Both efforts were extremely successful; all foreclosure proceedings were completely halted, and we were able to obtain a successful loan modification from Wells Fargo, who have a reputation as perhaps the most difficult bank to obtain a loan modification from.
