NJ Client Approved For Ocwen Loan Mod Days Before Sheriff's Sale

Sometimes it seems like things can't get any worse...and then they do.

That's what happened to a recent client of our firm, who I'll call Mr. Dunn to protect his privacy.

Mr. Dunn has a home in New Jersey that was damaged by Hurricane Sandy, the largest Atlantic hurricane on record, in 2012. Insurance didn't cover all of the repairs he needed to make to his home following the superstorm, so he had to pay for the rest out of pocket. Doing that reduced his savings.

Foreclosure Moratorium Available for FHA Homeowners Hit by Hurricane Irma

If your home or your ability to pay your mortgage was damaged by a presidentially-declared disaster, such as hurricanes Harvey, Irma, or Maria, you may qualify for a foreclosure moratorium.

The Department of Housing and Urban Development (HUD) website says:

“If you are at risk of losing your home because of the disaster, your lender may stop or delay initiation of foreclosure for 90 days. Lenders may also waive late fees for borrowers who may become delinquent on their loans as a result of the disaster.”

This help is much needed for many people affected by the recent hurricanes. Forced evacuations, missed work, damaged homes and property, injuries, and all kinds of extra expenses are contributing to people's financial hardships, which can leave them unable to make mortgage payments.

90 days delay on foreclosure initiation or a waiver on late fees is a big help in easing the burden caused by a disaster and could be the difference between keeping your home and losing it.

What Will the Terms of Your Loan Modification Be?

When you need a loan modification, you really need one. It might be the only way to save your home and avoid foreclosure. Getting one is great, but what will the terms of your loan modification be? Will they be great, with a lower monthly payment that you can easily afford, or will they be bad and cause you to default again?

It depends. Loan modifications have as much variety as the mortgages they modify and the people who get them. No one can tell you what terms you will have until your bank offers you a final loan modification.

In fact, no one can guarantee that you will get a loan modification at all, much less that it will have certain terms.

Hurricane Irma did more than $62 billion of damage in Florida and the Caribbean, making it the fourth-costliest hurricane on record. Homes and property were destroyed and damaged, 101 people died, and many endured serious hardships.

Survivors continue to clean up and try to return to their normal lives. Fortunately there is help available from the federal government, state government, and charities. Below are links and information on some of the help that's available.

FEMA, the Federal Emergency Management Agency, is involved in coordinating the response to Irma since a state of emergency was declared in Florida. You can go to FEMA.gov or Disasterassistance.gov for more information on a variety of programs to see if you are eligible for assistance and to apply. You can also call FEMA toll-free at 1-800-621-FEMA (1-800-621-3362).
