What to Do If You’re Facing Foreclosure This Summer

Summer is meant to be a time for relaxation—but if you’re behind on mortgage payments or have received a foreclosure notice, it can feel like the walls are closing in. The good news is: foreclosure is not the end of the road. You have options—and the sooner you act, the more of them you’ll have.

🔔 Step 1: Don’t Ignore the Notice

When a foreclosure notice arrives, it’s tempting to avoid it. Don’t. Opening and understanding that notice is the first step toward keeping your home or limiting the damage to your finances. There are strict deadlines, and missing them could make your situation worse.

🏦 Step 2: Know Where You Stand

You’ll need to know:

  • How far behind you are on payments
  • The current balance on your mortgage
  • Whether your loan is federally backed (FHA, VA, USDA, etc.)
  • If the lender has already filed in court (judicial foreclosure)

A foreclosure attorney can help you gather and interpret this info fast.

🛠️ Step 3: Explore Your Legal and Financial Options

There are several ways to stop or delay foreclosure, depending on your situation:

✅ Loan Modification

Negotiate with your lender to change the terms of your loan—often lowering payments or adding missed payments to the back of the loan.

✅ Chapter 13 Bankruptcy

Immediately halts foreclosure and gives you time to catch up on missed payments through a structured repayment plan.

✅ Short Sale

Sell your home for less than you owe with the lender’s approval, avoiding foreclosure on your credit record.

✅ Deed in Lieu of Foreclosure

Voluntarily transfer the property back to the lender in exchange for cancellation of the mortgage.

✅ Litigation or Legal Defenses

In some cases, improper servicing or lender mistakes can provide a legal defense that stops or delays foreclosure.
