Can I Check My Foreclosure Status in Florida?

Yes! You CAN check your foreclosure status online in most Florida counties. Some Florida Counties have very detailed and comprehensive case information and docket schedules on their website and available to the public. Other counties provide very limited, or no case information on their site - unless you create an account and pay for the case information.

Sometimes the foreclosure case information provided by the county is easy to understand, and makes it very clear if, for instance, you have a Case Management Conference or Summary Judgment upcoming.

Am I in foreclosure?

When discussing options with homeowners in Florida, a lawyer must always must know if you have been served a foreclosure lawsuit. Our attorneys and paralegals are always surprised that many homeowners in Florida do not know for certainty if their lender has initiated a foreclosure lawsuit.

There are many counties in Florida where you can check the Clerk or Comptroller's website and research to determine if there is a foreclosure law suit filed against you. At the very least, you should be able to find a foreclosure case number.

Remember that it's very important to seek counsel from an attorney to help interpret what you are reading, or to make sense of the foreclosure documents you have been served. Just as you wouldn't ask your grandma to come and fix your kitchen sink, you don't want to ask an untrained eye to review your foreclosure case.

I received foreclosure documents last year, am I still in foreclosure?

You most likely are!

Unless an Order Granting Dismissal and Release of Lis Pendens has been filed in your case, you are still in foreclosure. This is true even if you have received a loan modification and are making payments again. We recently met with a homeowner whose loan modification was finalized 6 months ago, but the Plaintiff filed a Motion requesting Default because the homeowner had not responded to the foreclosure complaint.

It's too true that one department doesn't know what the other is doing. If you have been served a Foreclosure Summons and Complaint, you are not safe from foreclosure until the case is dismissed. Check your foreclosure status using the below guide and be prepared.
